Arbitration; Class Action Waiver
EXCEPT WHERE PROHIBITED BY LAW, YOU AND NOVE SEA AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE PRODUCTS/SERVICES WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION, AND NOT IN A CLASS, REPRESENTATIVE, OR CONSOLIDATED ACTION OR PROCEEDING. YOU MAY OPT OUT OF ARBITRATION BY SENDING A WRITTEN OPT-OUT NOTICE TO contact@novesea.com WITHIN 30 DAYS AFTER YOU FIRST ACCEPT THESE TERMS. The Federal Arbitration Act governs this provision. If arbitration is found unenforceable for a particular claim, that claim may be resolved in court as provided below, but only on an individual basis.
Changes to These Terms
For material changes, we will post an update and, where required by law, provide at least 15 days’ advance notice before the effective date. Changes do not apply retroactively to orders already accepted by us. If you do not agree to the updated Terms, stop using the Services before the effective date.
Termination
These Terms remain in effect until terminated by either party. You may stop using the Services at any time. We may suspend or terminate your access if you materially breach these Terms. Termination will not affect rights and obligations accrued prior to termination, including our obligation to fulfill accepted orders.
Governing Law; Venue
These Terms and any dispute are governed by the laws of the State of New Mexico, without regard to its conflicts-of-law rules. The exclusive venue for any action is the state or federal courts located in Bernalillo County, New Mexico (Albuquerque), and you consent to personal jurisdiction there. For U.K. consumers, nothing in these Terms limits any mandatory consumer rights under U.K. law.
